Official Rules
Voice of Dance.com will be sponsoring an "Amazing Online Dance Video Contest" (this "Contest") in which Voice of Dance users can submit their home dance videos for evaluation by the public voters of Voice Of Dance. Each month (April 2008 - November 2008) the top video will receive a prize of a RCA Small Wonder Camcorder; a $200 gift certificate to Danskin.com; an interview on Voice Of Dance Radio; and a feature on Voice Of Dance. In December we will have a "Dance Off". The finalists from each month will be asked to submit a new video and the public will vote for the winner. The top overall video of the December Dance Off shall receive a prize of $1,000 and an Interview and Feature on Voice Of Dance. In addition, the top 5 overall winners will receive a $100 gift certificate to Danskin.com The most popular videos submitted each week shall be posted on the Voice of Dance.com website. To be a Voice Of Dance Voter you must register on Voice Of Dance, it is free to register.
Who May Participate.
This Contest is open only to individuals who submit their original, personally created videos to YouTube as described below. At the time of entry each entrant must be at least 18 years old and a resident of the United States. Void outside the United States, and where prohibited by law. Shareholders, directors, officers, and employees of VoiceofDance.com and their immediate family members are not eligible to participate. You must have access to the Internet and a valid email address in order to enter or win.
Contest Period.
This contest begins at 12:00 A.M., Pacific Daylight Time ("PDT") on April 3, 2008 and ends at 11:59 P.M. (PDT) on January 9, 2009 ("Contest Period"). First monthly voting will begin April 3, 2008 and end 11:59 P.M (PDT) on April 30, 2008. Second monthly voting will begin 12:00 A.M. Pacific Daylight Time (PDT) May 1, 2008 and end 11:59 P.M (PDT) May 31. 2008. Third monthly voting will begin 12:00 A.M. Pacific Daylight Time (PDT) June 1, 2008 and end 11:59 P.M (PDT) June 30, 2008, Fourth monthly voting will begin 12:00 A.M. Pacific Daylight Time (PDT) July 1, 2008 and end 11:59 P.M (PDT) July 31, 2008, Fifth monthly voting will begin 12:00 A.M. Pacific Daylight Time (PDT) August 1, 2008 and end 11:59 P.M (PDT) August 31, 2008, Sixth monthly voting will begin 12:00 A.M. Pacific Daylight Time (PDT) September 1, 2008 and end 11:59 P.M (PDT) September 30, 2008, Seventh monthly voting will begin 12:00 A.M. Pacific Daylight Time (PDT) October 1, 2008 and end 11:59 P.M (PDT) October 31, 2008, Eighth monthly voting will begin 12:00 A.M. Pacific Daylight Time (PDT) November 1, 2008 and will end 11:59 P.M (PDT) November 30, 2008. Monthly winners will be announced the first week of the following month (First Monthly winner will be announced May 5, 2008.) Finalists will be announced December 1, 2008. Finalists will have 1 week to submit another video for the final round, videos must be received by December 8, 2008. If finalists fail to submit a video in the designated time, they will be disqualified. The Dance Off voting will begin 12:00 A.M. Pacific Daylight Time (PDT) December 10, 2008 and end 11:59 P.M (PDT) January 10, 2009. The Grand Prize Winner will be announced Monday January 12th.
Video Requirements; How to Enter.
Create a video that is approximately 2-5 minutes in length showing you dancing (each submitted video will be considered one "Submission"). You may submit multiple Submissions, so long as each Submission meets all requirements. Each Submission should be personally created by you, original and creative, and appeal to Voice of Dance.com's audience. Only one of your entries will be allowed to be featured in the favorites and move on to the finals. Please review Voice of Dance.com's website at voiceofdance.com if you require more information. To enter you must register with YouTube. YouTube registration is free. Once you have completed the registration process and have created your video, upload it to your YouTube account, marking it as private and putting 'voiceofdancecontest' as a tag (this is a very important step so that you will be in the contest). Your use of the YouTube.com website is subject to the Terms of Use governing that site. Once that process is complete, return to the contest registration page at Voice Of Dance and complete the contest registration form.
Disqualifying Submissions.
Voice of Dance.com reserves the right to disqualify any entrants who submit any false information concerning identity, postal address, telephone number, originality and ownership of the Submission, or any Submission Voice of Dance.com believes infringes upon or violates the rights of any third party, or violates the Official Rules of this Contest, including any Submissions it deems in its sole discretion to be lewd, obscene, pornographic, disparaging of Voice of Dance.com or its audience or otherwise contain objectionable material. An entrant may be prohibited from participating in this Contest if, in Voice of Dance.com's sole discretion, it reasonably believes that the participant has attempted to undermine the legitimate operation of this Contest by cheating, deception, or other unfair playing practices or annoys, abuses, threatens or harasses any other participants, Voice of Dance.com or its audience.
Contest Criteria and Selection of Winner.
Voice of Dance.com will select one winner at the end of each Contest Period (the Monthly Prize Winner"), with the popular votes of the Voice Of Dance Voters. The voters will be able to vote on their weekly favorites as the videos that are posted throughout the month. The most popular 3 will be featured on the site each week. Starting April 3, 2008, Voters will vote for their favorite monthly videos to move onto the Final Dance Off in December. Each month we will announce the previous month's winner. Monthly winners will receive a RCA Small Wonder Camcorder; a $200 gift certificate to Danskin.com; an interview on Voice Of Dance Radio; and a feature on Voice Of Dance. On December 1,2008 the finalists will be announced and they will be asked to submit another Finals Video by December 8, 2008. Voice Of Dance Voters will vote on the Final videos December 10, 2008- January 10, 2009. The Grand Prize Winner shall be announced on Voice of Dance.com's website on January 12, 2009 after the end of the Contest Period and shall receive a prize of $1,000. The top most popular videos of the year long contest will also be announced and they will each receive a $100 gift certificate to Danskin.com. Any required taxes and any applicable withholding and reporting requirements are the sole responsibility of the Grand Prize Winner. Weekly winners shall have their Submission posted on the Voice of Dance.com website, with the Winner's name listed with the Submission.
Conditions of Participation.
By entering a Submission into this Contest, an entrant agrees to be bound by the terms of these Official Rules and by the decisions of Voice of Dance.com, which are final and binding on all matters pertaining to this Contest. Any potential winner who cannot be contacted within 15 days of first attempted notification will forfeit his/her prize and an alternate may be selected. Potential prize winner(s) may be required to sign and return a Declaration of Eligibility/Liability & Publicity Release within 30 days following the date of first attempted notification. Failure to comply within this time period may result in disqualification and selection of an alternate winner. All Submissions remain the property of entrant, provided, however, by entering the Submission, each entrant grants to Voice of Dance.com, and Voice of Dance.com acknowledges that its ownership rights in the Submission shall be limited to, an unconditional, royalty-free, non-exclusive, irrevocable, worldwide, perpetual license in and to the Submission (the "License"). By entering the Submission, entrant represents that (s)he has the unrestricted right to enter the Submission and to grant the License to Voice of Dance.com and the Submission does not infringe upon any third party's proprietary or other rights. Voice of Dance.com will have the unrestricted right to use, alter, publish, and display each Submission and/or transfer its License rights in and to each Submission however it sees fit without further approval of or payment to entrant. Acceptance of the prize constitutes permission for, and winners consent to, Voice of Dance.com to use a winner's name and/or likeness and entry for advertising and promotional purposes without additional compensation, unless prohibited by law. To the extent permitted by law, entrants agree to hold Voice of Dance.com, its agents, directors, officers, employees, representatives and assigns harmless from any injury or damage caused or claimed to be caused by participation in this Contest. All federal, state, provincial and local laws and regulations apply.
Reservation of Rights; Non-Responsibility.
Voice of Dance.com is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission. Voice of Dance.com is not responsible for theft or destruction or unauthorized access to or alterations of Submissions, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind. If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, disruption or termination of the YouTube.com website for any reason or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Voice of Dance.com reserves the right at its sole discretion to immediately cancel, terminate, modify or suspend this Contest. Voice of Dance.com reserves the right to select winners from eligible entries received as of the termination date. Voice of Dance.com further reserves the right to disqualify any individual who tampers with the entry process. Voice of Dance.com is not responsible for any typographical or other error in the printing of the offer, administration of this Contest or in the announcement of the prize. Entrants agree that personal data, especially name and address, may be processed, stored and otherwise used for the purposes and within the context of this Contest and any other purposes outlined in these Official Rules. The data may also be used by Voice of Dance.com in order to check entrant's identity, postal address and telephone number, or to otherwise verify entrant's eligibility to participate in this Contest and to receive any prize. Entrants agree that any personal data or other information provided on the YouTube.com website in order to participate in this Contest will be subject to the terms of the privacy policy posted on the YouTube.com website and Voice of Dance.com shall have no liability or responsibility in connection therewith. Participants agree that these Official Rules are governed by the laws of the state of California, USA.
Entrant's Warranty Regarding Submission and Indemnification of Voice of Dance.com.
Each entrant certifies that their Submission is original and that entrant is the sole and exclusive owner and right holder of the Submission, and that entrant has the right to submit the Submission in this Contest. Each entrant agrees not to enter any Submission that infringes any proprietary, intellectual property, personal rights or other rights of a third party, including without limitation, copyright, trademark, patent, trade secret or confidentiality obligation; or otherwise violates applicable law. To the maximum extent permitted by law, each entrant indemnifies and agrees to keep indemnified Voice of Dance.com, its agents, directors, officers, employees, representatives and assigns harmless at all times from and against any liability, claims, demands, losses, damages, costs and expenses resulting from any act, default or omission of the participant and/or a breach of any warranty set forth herein. To the maximum extent permitted by law, each participant indemnifies and agrees to keep indemnified the Voice of Dance.com, its agents, directors, officers, employees, representatives and assigns harmless at all times from and against any liability, actions, claims, demands, losses, damages, costs and expenses for or in respect of which Voice of Dance.com will or may become liable by reason of or related or incidental to any act, default or omission by a participant under these rules.
